IMPORTANT: If an owner’s account is not current, the owner and his/her tenant will be denied the use of the Clubhouse. For any maintenance emergency, please call our emergency number at (301) 421-4966.
The LABHOA and Member understand and agree to the following:
Member is defined as an Lakeview At Brandywine Homeowner (or legal resident) for purposes of this agreement.
The Member will be present at all times to supervise the use of the Clubhouse.
The Member shall have the use of the Clubhouse for Member’s benefit and the benefit of Member’s guests.
This agreement is subject to the following provisions and restrictions: 1. The use of the Clubhouse is limited to official association business and Members of LABHOA. If at any time a Member rents the Clubhouse and then turns it over to an outside party; that Member will forfeit all future Clubhouse rental privileges.
2. The rental fees are as follows:
a) FullDay --$250.00 rental fee plus a $250 Deposit
3.a Any LABHOA property that is found broken, damaged or removed from the clubhouse or grounds by the Member or the Member’s guests or broken, damaged or removed as a result of the Member’s failure to adequately secure the Clubhouse after use shall be the responsibility of the Member and shall be paid for by the Member. The LABHOA reserves the right to retain any and all of the deposit necessary to pay for LABHOA property which is broken, damaged or removed from the Clubhouse or grounds. It is agreed that the Member shall pay to the LABHOA, on demand, any additional sum necessary to repair or replace broken, damaged or missing property in the event the cost exceeds the amount of the deposit.
Please note; the rental fee and deposit must be received within ten (10) calendar days of the initial date of the reservation.Payment must be made by Certified Check or Money Order, payable to Lakeview At Brandywine Homeowners Association (The word ‘Clubhouse’ and rental date must be listed in memo section). The rental fee is non-refundable within 30 days of the event, except in cases of emergencies such as serious illness or death of a family member. In such cases, the user must send a written request to the Board of Directors for consideration of a refund.
3.b Deposits shall be forfeited by the Member when the use of the Clubhouse results in any event beyond the ordinary operations of the Clubhouse. These events include, but are not limited to:
Any of the LABHOA Board Members (or its agents) contacted to physically visit the Clubhouse
The police having to respond to the Clubhouse
A false alarm being sounded from the incorrect or inappropriate use of the alarm system
4. The LABHOA assumes no responsibility for the property of the Member or the Member’s guests, including but not limited to vehicles parked in the Clubhouse parking lot and their contents, and shall not be liable in the event any such property is lost, stolen or damaged while on LABHOA’s premises.
5. The Member hereby agrees to be solely responsible for any accident or injury to any person attending this function or caused by the Member’s failure to adhere to the provisions of this agreement and the Member agrees to indemnify and hold LABHOA harmless for any sum for which the LABHOA may be found liable as a result of any such accident or injury. Further, the provisions of this paragraph shall apply to any individual injured on LABHOA property when said injury is the result of actions of failures to act by the Member of Member’s guests.
6. Parking for all events will be limited to Oxon Run and Visitor spaces immediately surrounding the Clubhouse (by Tennis Court). Do not park in numbered spaces. Towing will be strictly enforced at car owner’s expense. Please inform all guests of this regulation.
7.The Clubhouse shall close no later than 10:00 p.m. weeknights and 1:00 a.m. on Friday, Saturday or Evening before Holidays.
8.The consumption of alcoholic beverages is permitted ONLY inside the Clubhouse.
9. The following activities are strictly prohibited in or around the Clubhouse:
Use of Drugs or Controlled Substances
Gambling
Sale of Alcoholic Beverages
Rowdiness, Brawling or Fighting
Public Nuisance Resulting in the Police being contacted
Do not Use Fireplace
Excessively Loud Music which can be heard outside the building
No Alcoholic beverages permitted to minors
10. Homeowners/Renters and/or their guests are prohibited from charging admission (selling tickets and/or collecting admission fees) or accepting donations, either in advance or at-the-door, for the purpose of guests gaining entry into the Clubhouse. Violation of this provision will result in the homeowner/renter’s privileges to rent the Clubhouse being terminated permanently.(Initial here)
11. Under no circumstances will outdoor amplification of music be permitted.
12. The Member is responsible for cleaning the Clubhouse after use, removing all decorations and returning furniture to its original location (some cleaning supplies are under the kitchen sink, vacuum in the closet). You may leave the trash in the clubhouse; however, all trash must be bagged accordingly as to not allow seepage, and left at the front door on the tile floor. Plastic trash bags must be placed in the wastebaskets. NO DECORATIONS ARE ALLOWED ON THE WALLS OF THE CLUBHOUSE (except at the fireplace).
13. Any permanent spots or stains found on the carpet after your rental forfeits 50% of your deposit. For your convenience, a bottle of carpet cleaner is located under the kitchen sink. (Initial here)
14. The kitchen must be left clean, including the refrigerator. All faucets and toilets must be checked for running or dripping water after every function.
15. All doors and windows are to be checked and locked, INCLUDING FRENCH DOORS LEADING TO DECK.
16.Total occupancy will not exceed (175) maximum Clubhouse occupancy number (as required by Maryland State Fire Codes.
17. All activities where the majority of the guests are under the age of twenty-one (21), the Member must be present at all times and supervise the use of the Clubhouse.
18. I understand that the Prince Georges County Police Officers and Lakeview At Brandywine HOA Officials, or its Agents are authorized to enter and use the clubhouse office and facilities during the time of my rental of the LABHOA clubhouse. (Initial here)
